Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SPARK mobile application and the sparknec.com website (together, the "Service"), operated by SPARK ("SPARK," "we," "us," or "our").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What SPARK Is
SPARK is an AI-powered educational and self-check tool for electrical apprentices and foremen. You submit a photograph of electrical work, and our AI returns a Pass/Fail assessment with citations to the 2023 National Electrical Code ("NEC"). Foremen who use SPARK can review work submitted by apprentices on their team.
SPARK is NOT a licensed inspection. SPARK does not replace your jurisdiction's authority having jurisdiction (AHJ), a licensed electrical inspector, your foreman's professional judgment, or your obligations under applicable codes and laws. SPARK's output is informational only and may be incorrect.
2. AI Disclaimers — Read This
The AI that powers SPARK is a probabilistic model. It can produce results that are:
- False positives — flagging compliant work as non-compliant.
- False negatives — failing to flag non-compliant work, including work that may be unsafe.
- Hallucinated — citing NEC sections incorrectly or generating reasoning that is not grounded in the photo or the code.
You must independently verify every result against the actual NEC text, your jurisdiction's adopted code, and the work being inspected. Never rely solely on SPARK to determine whether electrical work is safe, complete, or code-compliant.
3. Eligibility
You must be at least 18 years old and legally capable of entering into a contract to use SPARK. The Service is intended for use in connection with bona fide electrical work, training, or apprenticeship.
4. Your Account
- You are responsible for keeping your sign-in credentials (Apple ID or Google account) secure.
- You are responsible for all activity that happens under your account.
- You agree to provide accurate role information (apprentice or foreman) and to update it if it changes.
- You may delete your account at any time from the in-app Settings screen.
5. Acceptable Use
When using SPARK, you agree not to:
- Use the Service in violation of any applicable law, regulation, or NEC requirement.
- Submit photos that contain unlawful, harassing, defamatory, or invasive content, or content that infringes someone else's rights.
- Reverse engineer, scrape, or attempt to access non-public parts of the Service.
- Use the Service to provide a competing AI inspection product without our written permission.
- Misrepresent SPARK's output to clients, inspectors, or employers as the result of a licensed inspection.
6. Content You Submit
You retain ownership of the photos and other content you submit to SPARK. By submitting content, you grant SPARK a worldwide, non-exclusive, royalty-free license to host, process, and display that content as necessary to operate the Service — including transmitting it to our AI provider for analysis and showing it to your linked foreman if applicable.
We may use anonymized or aggregated content (with personally identifying details removed) to improve the Service. We will not use the content of your photos for advertising and will not sell your content.
7. Our Intellectual Property
The SPARK app, the SPARK name, the SPARK logo, and the design of the Service are owned by SPARK and protected by copyright, trademark, and other laws. You may not copy or redistribute them without our permission. References to "NEC" and the National Electrical Code are owned by the National Fire Protection Association (NFPA) and used here for descriptive purposes.
8. Third-Party Services
SPARK relies on third parties including Google (Gemini AI), Apple (Sign In with Apple), Firebase, PostHog, and Railway. Your use of those services is also governed by their own terms and privacy policies. We are not responsible for the practices of these third parties.
9. Service Availability and Changes
We may modify, suspend, or discontinue parts of the Service at any time, with or without notice. We may also impose limits on usage, storage, or features. The Service is provided on an "as-available" basis. We do not guarantee uninterrupted access or that any particular feature will continue to exist.
10. Termination
You can stop using SPARK at any time. We can suspend or terminate your account if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and dispute resolution) will survive.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE ERROR-FREE, ACCURATE, OR UNINTERRUPTED.
SPARK DOES NOT WARRANT THAT THE AI'S OUTPUT IS CORRECT, COMPLETE, OR COMPLIANT WITH ANY APPLICABLE CODE OR STANDARD. YOU USE THE SERVICE AT YOUR OWN RISK.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SPARK AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
WITHOUT LIMITING THE FOREGOING, SPARK'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
THIS INCLUDES, WITHOUT LIMITATION, ANY DAMAGES RELATED TO ELECTRICAL WORK PERFORMED, FAILED INSPECTIONS, PROPERTY DAMAGE, INJURY, FINES, REWORK COSTS, OR ANY OTHER LOSS THAT RESULTS FROM RELIANCE ON THE SERVICE.
13. Indemnification
You agree to indemnify and hold harmless SPARK, its affiliates, and its personnel from any claim or demand, including reasonable attorneys' fees, arising out of your use of the Service, your content, your violation of these Terms, or your violation of any law or the rights of a third party.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of [YOUR STATE], without regard to its conflict-of-laws principles. Any dispute arising out of these Terms or the Service will be brought exclusively in the state or federal courts located in [YOUR COUNTY, YOUR STATE], and you consent to the personal jurisdiction of those courts.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you in-app or by email where appropriate. Continued use of the Service after changes take effect means you accept the revised Terms.
